This Consumer Agreement (“Agreement”) is entered into between ResQBox Food India Private Limited (CIN: U63120TS2026FTC214890) (“ResQBox”, “we”, “us”, or “our”), an Indian private limited company, and the individual consumer (“Consumer”, “you”, or “your”) who accesses or uses the ResQBox Food platform (“ResQBox Food”, “Platform”). By registering, accessing, or using the Platform, you agree to be bound by the terms and conditions set out below.
1. Purpose of the Platform
1.1 ResQBox Food is a digital marketplace operated by ResQBox that enables Consumers to purchase surplus food boxes listed by participating restaurants and food vendors (“Vendors”). ResQBox operates as a marketplace e-commerce entity within the meaning of the Consumer Protection (E-Commerce) Rules, 2020.
1.2 ResQBox acts solely as a facilitator and does not prepare, own, store, or manage any food listed on the Platform.
1.3 Meal Boxes and Custom Boxes. A “Meal Box” is a fixed-price package of surplus food sold by an FSSAI-licensed Vendor for same-day pickup. Each Meal Box listing discloses, before purchase: (a) the box composition — the number and type of items (for example, 1 main course + 1 side + 1 bread); (b) the dietary category (vegetarian, non-vegetarian, vegan, Jain, or halal); (c) the cuisine type; (d) the price and the minimum original retail value of the contents, which is at least twice the price paid; and (e) the pickup window. The specific dishes within the disclosed composition are drawn from the Vendor's available surplus and are confirmed at pickup. A “Custom Box” is a listing that identifies the specific items included, with descriptions and photographs, before purchase.
1.4 The Vendor warrants that all food included in any Meal Box or Custom Box is safe for consumption at the time of pickup and has been prepared, stored, and handled in accordance with the Food Safety and Standards Act, 2006 and applicable FSSAI regulations.
2. Account Registration
2.1 Eligibility
To use the Platform, you must be at least eighteen (18) years of age, be competent to contract under the Indian Contract Act, 1872, and must not be prohibited from using the Platform under any applicable law. By creating an account or placing an order, you confirm that you meet these requirements.
2.2 Account and Credentials
When you create or use an account on the Platform, you agree:
(a) To provide accurate, current and complete information during registration and to update that information promptly if it changes.
(b) To keep your account credentials (including password, OTP codes, and any linked authentication providers) confidential and not to share them with any other person.
(c) That you are responsible for all activity that occurs under your account, whether or not authorised by you.
(d) To notify us immediately at team@nousattva.com if you become aware of any unauthorised access to, or use of, your account.
(e) That we may suspend or terminate your account in accordance with Section 2.3 if we reasonably believe these obligations have been breached.
2.3 ResQBox reserves the right to suspend or terminate your account for any misuse, breach of this Agreement, or unlawful activity.
3. Location Services
3.1 Upon logging into the Platform, you may be prompted to enable location services on your device.
3.2 Location data is used to:
- Display nearby Vendors who have listed surplus food boxes;
- Provide accurate pickup location details and estimated travel distances; and
- Improve search relevance and user experience.
3.3 You may decline location access; however, certain features of the Platform may be limited.
3.4 Location data is handled in accordance with ResQBox's Privacy Policy.
4. Ordering and Payment
4.1 Orders must be placed through the Platform using approved payment methods. All prices on the Platform are displayed in Indian Rupees (₹).
4.2 Payment Processing:
- ResQBox will use a secure third-party payment processor (to be confirmed — Cashfree or Razorpay).
- By placing an order, you agree to the payment processor's terms of service.
- ResQBox does not collect, store, or view your full credit card or banking details.
4.3 Full payment is required at the time of order placement.
4.4 You will receive a digital confirmation and order reference number upon successful payment.
4.5 All orders are subject to Vendor acceptance. If an order is rejected, a full refund will be issued.
5. Pickup and Collection
5.1 You must collect your order from the Vendor within the designated pickup window.
5.2 You are required to present your order reference number at the time of collection.
5.3 If you fail to collect your order, the Vendor may mark the order as “Not Collected” and you may not be eligible for a refund.
5.4 At the Vendor's sole discretion, the same order may be provided to you on a later date without additional charge, provided you submit a request through ResQBox Food.
6. Cancellations and Refunds
6.1 You may cancel an order prior to Vendor acceptance. Once accepted, cancellation is subject to Vendor approval.
6.2 If a Vendor cancels your order, you will receive a full refund.
6.3 Refunds are issued at ResQBox's discretion and may be granted for:
- Incorrect or misleading listings;
- Food safety concerns; or
- Vendor cancellation.
6.4 Refunds will be processed to your original payment method via our payment processor.
6.5 Nothing in this Agreement limits any rights you have under the Consumer Protection Act, 2019 that cannot lawfully be excluded or modified.
7. Consumer Obligations
7.1 You agree to:
- Use the Platform lawfully and respectfully;
- Not engage in fraudulent, abusive, or disruptive conduct;
- Provide honest feedback and report issues through official channels; and
- Comply with Vendor pickup instructions and timeframes.
8. Platform Limitations
8.1 ResQBox does not:
- Guarantee the quality, safety, or suitability of food listed by Vendors;
- Endorse or verify Vendor claims; or
- Assume liability for food-related incidents, delays, or disputes.
8.2 All food-related concerns should be directed to the Vendor. ResQBox may assist in dispute resolution but is not responsible for Vendor conduct. This does not limit your right to seek redress through the consumer dispute redressal commissions established under the Consumer Protection Act, 2019.
9. Data Privacy
9.1 ResQBox collects and processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000, and the SPDI Rules, 2011.
9.2 Payment Security: All financial transactions are secured by our payment processor. ResQBox does not hold sensitive financial data.

10. Intellectual Property
10.1 All content, branding, software, and listings on the Platform are owned or licensed by ResQBox.
10.2 You may not copy, reproduce, modify, or distribute any part of the Platform without prior written consent.
11. Termination
11.1 ResQBox may suspend or terminate your account immediately for:
- Breach of this Agreement;
- Fraudulent or abusive behavior; or
- Violation of applicable laws or regulations.
12. Governing Law
12.1 This Agreement is governed by and construed in accordance with the laws of India.
12.2 Subject to any non-excludable rights you have under the Consumer Protection Act, 2019, any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana.
13. Amendments
13.1 ResQBox may amend this Agreement at any time.
13.2 You will be notified of changes via the Platform. Continued use of the Platform constitutes acceptance of the amended Terms.
